1. Introduction - what is personal data?

“Personal data” means any information which can be directly or indirectly attributed to a natural person who is alive.
Charge Node Europé AB is the data controller for the data you provide via www.chargenode.eu, through the use of our services or that is obtained by us from any other source.
Within Charge Node Europé AB, personal data is always processed with great respect for personal privacy.
Below is a description of the policies applied by Charge Node Europé AB, how we handle and store the information and what rights you have.
The guidelines never restrict the rights that apply under the General Data Protection Regulation or any other legally binding provision.

2. Collection of personal data

The information on this page applies to Charge Node Europé AB and the website www.chargenode.eu, unless otherwise stated.
For further information about the personal data processing etc. of other companies owned by Charge Node Europé AB, please refer to the respective companies and their websites, if any.

3. ChargeNode's websites

In general, www.chargenode.eu can be visited without collecting personal data. We then only collect information that is used for statistical purposes and the visitor remains anonymous. Examples of such information are the time of the visit, the duration of the visit and the pages visited. Charge Node Europé AB also uses so-called “cookies” to ensure that the functions and services on the website function properly.

When you as a customer visit Charge Node Europé AB’s logged-in services, the visit can be linked to the logged-in person’s customer number. This allows Charge Node Europé AB to provide more relevant and personalised communications to individual customers.

4. Categories of personal data

The categories of personal data that we typically collect are:

Customer information – i.e. the information needed to become and remain a customer with us.
Examples include name, address, email address, telephone number, social security number, organisation number, bank details, vehicle registration number, GPS location and other user data from our services.

Purchase information – i.e. products and services purchased, credit rating, payment history, customer number and password.

Technical information – electricity and network supplier, installation number and type of connection.

Service information – i.e. correspondence on specific matters, details of purchases and any complaints or claims.
Responses to customer surveys and feedback on our products and services.
Where appropriate, information submitted in connection with competitions or other customer loyalty programmes.

Demographic information (from public registers) – i.e. age, gender, living space, household constellation, etc.
Visitor information on logged-in services – i.e. purchase and user-generated data, passwords, technical data related to the device used, interaction data (visit time, response times, how you reach and leave the service, etc.).
Special categories of personal data (defined in Art 9 p 1 GDPR) are processed only in exceptional cases.
For the processing of personal data in these cases, we need to obtain your consent.
There are also occasions when we are required by law to collect and process this type of sensitive personal data.

5. Information when data is collected

6. Purposes and legal basis for processing

We only collect personal data for purposes that are supported by the applicable data protection regulation.
Most commonly, the data is collected for processing on the legal basis of performance of a contract.
The purposes are, for example, for marketing and profiling, i.e. to communicate relevant offers to our customers.

– to send newsletters.
– to develop and improve our products and services.
– for statistics and analysis.

We also process personal data if this is necessary to fulfil our or third parties’ legitimate interest in analysing user data from our services in order to further develop and improve our/third parties’ services.

Other purposes for our processing of personal data may have their legal basis in various legal requirements, i.e. where we have to comply with a legal obligation, examples of such purposes are the processing of personal data under the Accounting Act for invoicing purposes or when we communicate information on changed contractual terms.
You may also consent to processing in certain cases where none of the above applies.
Consent given is an active act on your part and can be withdrawn.
We will then not further process your personal data for that purpose.

7. Disclosure of personal data

As Charge Node Europé AB has subsidiaries with group-wide functions, your personal data may be disclosed to other companies within the group.
Such companies may also process your data for the purpose of providing offers and marketing on products and services that may be of interest to you.

In certain circumstances, we may also transfer personal data to data processors, partners or other third parties.
For example, user data in the form of vehicle registration numbers may be shared with individual parking companies when charging takes place at charging points/systems at the Customer’s premises in order to further develop and improve the Customer’s services.

In the event of a transfer, Charge Node Europé AB will take into account the specific laws and regulations governing the separation of electricity trading companies from electricity network companies (so-called “unbundling rules.
We may in certain cases, upon request by law and by decision of public authorities, be obliged to disclose personal data to, for example, the police, for crime prevention measures and criminal investigations.

Personal data is not normally provided to companies outside the EU or EEA.
However, in certain situations, the data may be transferred to, and processed in, a country outside the EU/EEA by a company within the Charge Node Europé AB group or by another supplier or subcontractor.
In these cases, a specific investigation is always made to ensure that safeguards, such as data transfer agreements, are in place so that the recipients process the data at a comparable level to the protection offered within the EU/EEA.

8. Access to personal data

Only those who need access to the personal data to perform the agreed service are authorised to access and manage it.
We have several subcontractors who handle personal data to varying degrees and they have the same requirements for handling as Charge Node Europé AB has internally.

9. Gallring

We do not keep personal data longer than necessary.
When the contract ends and you are no longer our customer, we keep your data for 36 months.
The same applies to contact details for our business customers.
However, some data may need to be kept for longer to meet other legal requirements, such as the Accounting Act where we need to keep data for 7 years.
There are also reasons to keep the data for longer if there is an ongoing investigation or dispute, even if the customer relationship has already ended, or in cases where you have purchased a product from us where we need to keep the data in order to fulfil our warranty obligation.

10. Security

We take specific physical, technical and organisational measures to protect the personal data processed so that the data is not lost, destroyed, manipulated or made available to unauthorised persons.
These measures are aimed at achieving a level of security that is sufficiently high, taking into account the technical possibilities available.
Changes to personal data are continuously recorded to ensure the traceability of any changes to the information.
Incidents concerning personal data are reported internally and by our subcontractors.
These are handled in an internal process and, in relevant cases (if there is a high risk to the rights and freedoms of the individual), are reported to the Data Protection Inspectorate within 72 hours and to the person who lost their information in accordance with the rules laid down in the Data Protection Act.
Data breaches are also reported to the police.

11. Your rights

Right of access

Everyone has the right to obtain information about the extent to which data relating to them is processed by Charge Node Europé AB.
If such personal data are held by Charge Node Europé AB, the person concerned shall, upon request, be informed of the categories of personal data being processed, the source from which they were obtained, the purpose or purposes of the processing, the legal basis and the recipient or recipients of the disclosure.
The person requesting the information must be able to identify himself/herself.
Charge Node Europé AB will send a reply to the civil registration address registered with Charge Node Europé AB within 1 month of receiving the request.

Right to rectification

Everyone has the right to request correction of their own customer information if it is inaccurate or processed in violation of applicable law.

Right to erasure

Charge Node Europé AB deletes personal data when there is no legal basis for retaining the data.
Our customers have the right to have their personal data deleted immediately if any of the following applies:

  • The processing is based solely on your consent, which you withdraw.
  • The data is no longer needed for the purposes for which it was processed.
  • The processing is carried out for direct marketing purposes and you object to the data being processed for that purpose.
  • The information has not been processed in accordance with the Regulation.
  • You object to processing that is carried out after a balancing of interests and the legitimate grounds do not override your interest.
  • Erasure is required to comply with a legal obligation.

Right to object to automated decision-making

Charge Node Europé AB does not apply automated decision-making in any area to the data subject.

Right to restriction of processing

In certain cases, you have the right to request that the processing of your personal data be restricted.
This applies, for example, if you believe that the personal data is inaccurate and you have requested rectification.
While the investigation is ongoing, you may request that the processing of your personal data be restricted.

You may be entitled to compensation in certain cases, for example if our processing of your personal data has caused you harm.
Claims can be made directly to Charge Node Europé AB.
